What are the keys to compliance?

Prevention and Reduction

Ban on unnecessary formats (such as single-use plastics in the hospitality sector) and strict reduction of “over-packaging.”

Reuse

Promotion of return systems and reverse logistics, setting progressive quotas for reusable packaging (such as pallets and B2B crates).

Full Recyclability

Ecodesign is mandatory; by 2030, all packaging must be recyclable and contain minimum percentages of recycled plastic.

Technical File and Marking

Preparation of required conformity documentation, regulatory labeling, and control of restricted substances (such as heavy metals or PFAS).

Registration and EPR (Extended Producer Responsibility)

Management of registration in MITECO’s Registry of Product Producers (RPP) (Art. 15 RDERE), processing of annual packaging declarations, and advisory services regarding membership in a Collective Extended Producer Responsibility Scheme (SCRAP).

Technical Dossier

Preparation of the Technical File (Annex VII) and formal drafting of the EU Declaration of Conformity (CoC).

PPWR Diagnosis and Analysis

Assessment of the company’s precise legal role, review of the packaging portfolio (compliance with heavy metal and PFAS limits by August 2026), and verification of suppliers’ EU Declarations of Conformity (CoC).

Eco-design, marking, and minimization

Technical advice on symbology/marking, weight and volume minimization, void space control, and recyclability classification (Grades A, B, or C).

Yes, producers and packers who place packaged products on the market for the first time must register with MITECO’s Register of Product Producers (RPP) and are required to submit annual declarations regarding the packaging placed on the market.

What happens if I import products or packaging from outside the European Union?

As an importer, you assume legal responsibility for ensuring that all packaging complies with European regulations (PPWR/RD 1055/2022), including labeling, the absence of prohibited substances (such as PFAS or heavy metals), and the existence of EU Declarations of Conformity (CoC).

What are the EU Declaration of Conformity (CoC) and the Technical File?

This is the mandatory technical documentation (Technical File, Annex VII) certifying that the packaging complies with the requirements regarding minimization, recyclability, and composition established by the European Regulation; it is essential to avoid obstacles to marketing.

What deadlines or key dates does the regulation establish for packaging?

Among other key milestones, August 2026 stands out for the review and compliance regarding strict limits on substances such as heavy metals and PFAS, as well as the 2030 target, by which all packaging placed on the market must be 100% recyclable (Grades A, B, or C) and incorporate a minimum level of recycled content.
