What is an LGBTI+ Plan?
LGTBI+ Plan
The LGTBI Plan is a set of measures aimed at preventing the existence of all types of discrimination and/or humiliating behavior against LGTBI+ people in the work environment.
Known as the Trans Law, law 4/2023 of February 28 for the real and effective equality of trans people and for the guarantee of the rights of LGTBI+ people.
Who is it mandatory for?
According to the Royal Decree published in the BOE on 09/10/2024:
- All companies with more than 50 employees must have an LGTBI+ Plan in place.
- The LGTBI+ plan is mandatory for public entities or companies that work with them.
When does it come into effect?
The LGTBI+ Plan comes into effect on Saturday, March 2, 2024. And it is from that day that all companies should have it implemented or in the process of implementation.
This period ends after 12 months from March 2, 2023, when Law 4/2023 came into force.
How much does an LGBTI Plan cost?
At Ingade, the LGTBI+ Plan is free for current and new client companies that require an Equality Plan and, therefore, the LGTBI+ Plan.
Companies with a current contract or an Equality Plan implemented by Ingade don’t need to worry because we will take care of everything.
What happens if it’s not implemented? What are the penalties?
Financial penalties for not having an LGTBI+ Plan in place
The LGTBI+ Plan is mandatory for companies with more than 50 employees; failure to do so by March 2, 2024, will result in the following penalties:
Minor violations
From €200 to €2000
Very serious violations
From €10,001 to €150,000
Prohibition of accessing public aid for a period of 1 to 3 years depending on the type of violation.
Serious violations
From €2001 to €10,000
Total or partial elimination or cancellation of subsidies
Prohibition of contracting with Public Entities, Administration and/or Autonomous Organizations associated with them for a period of 1 to 3 years depending on the type of infraction.
Frequently asked questions
The LGTBI+ Plan or “Trans Law” Plan is mandatory from March 2, 2024 for:
- Companies with more than 50 employees, including private, public and non-profit associations.
- Companies that require it under their collective agreement.
- Companies obligated through sanctioning procedure.
- Cooperative societies in which there are employed persons under the terms and conditions described above.
From March 2, 2024 for companies with more than 50 employees.
The protocol or set of measures should include, among other things:
- Measures to ensure the non-exclusion of LGBTI+ people in a work environment.
- Actions and procedures to identify, prevent and respond to cases of harassment, violence or degrading treatment of LGBTI+ people
The LGTBI+ Plan for companies is within the framework of Law 4/2023, of February 28, for the real and effective equality of trans people and for the guarantee of the rights of LGTBI+ people, known as the Trans Law.
The LGBTI+ Plan aims to guarantee the rights of these individuals, with the goal of eliminating any form of discrimination. Furthermore, it seeks to promote the hiring of transgender people based on equal opportunity criteria.
