As a general rule, all companies with 50 or more workers on their staff must do it.

In addition, it can have other negative consequences such as:
- If the company has 50 workers, it will not be able to work with the Public Administration if it does not have an Equality Plan.
- Loss of any aid, subsidy or bonus related to job creation programs.
- Currently, companies without an Equality Plan cannot participate in hiring aid.
- Prohibition of accessing any of this aid for a minimum period of 6 months.

According to Royal Decree published in the BOE on 10/09/2024:
- All companies with more than 50 workers must have an LGTBI+ plan implemented.
- The LGTBI+ plan is mandatory for public entities or companies that work with them.
Minor violations
from €200 to €2000.
Serious violations
from €2001 to €10,000.
Very serious violations
from €10,001 to €150,000.
- Total or partial suspension or cancellation of subsidies.
- Prohibition of accessing public aid for a period of 1 to 3 years depending on the type of violation.
- Prohibition of contracting with Public Entities, Administration and/or Autonomous Organizations associated with them for a period of 1 to 3 years depending on the type of infraction.
